MyFita respects intellectual property rights and expects everyone using the Platform to do the same. This page explains how to report content you believe infringes your copyright, trade mark or other IP right, and what we do when we receive a report.
We act in accordance with the Copyright Act, 2005 (Act 690), the Trade Marks Act, 2004 (Act 664) and the Electronic Transactions Act, 2008 (Act 772) of Ghana.
1. Our position
Vendors and users publish their own listings, photographs and descriptions. We do not review every item before it appears. When told content infringes someone's rights, we investigate and act promptly — which may include removing content, disabling a listing, or suspending the account.
2. Before you send a notice
Consider whether the use might be permitted — e.g. a vendor may lawfully use a manufacturer's part name to describe a genuine part. Describing a genuine Toyota part as a Toyota part is not trade mark infringement. Selling a counterfeit part branded as Toyota is.
Submitting a notice in bad faith, or to remove a legitimate competitor, may expose you to liability.
3. How to report
Send to info@partsmarthub.com, subject line "IP Infringement Notice", including:
- Your full name, company name (if applicable), postal address, email and phone.
- A clear description of the work or mark you own.
- Evidence of ownership or authority to act on the owner's behalf.
- The exact location of the infringing material on MyFita (listing URL, title, or vendor storefront name). A notice without this cannot be actioned.
- A good-faith statement that the use is not authorised.
- A statement that the information is accurate and you're authorised to act.
- Your signature (physical or electronic).
Incomplete notices delay removal. Send what you have and our team will tell you what's missing.
4. What happens next
| Step | What we do | Timeframe |
|---|---|---|
| Acknowledgement | We confirm receipt | Within 2 business days |
| Review | We assess the notice and content, may ask for more info | Within 5 business days of a complete notice |
| Action | Where substantiated, we remove/disable content and notify the user | Promptly on conclusion of review |
| Outcome | We confirm what action was taken | Within 2 business days of acting |
Where a listing appears to involve counterfeit or unsafe goods, we may remove it immediately while investigating.
5. If your content was removed
If you believe a removal was a mistake, send a counter-notice to info@partsmarthub.com, subject "IP Counter-Notice", including your contact details, identification of the removed content, an explanation with supporting evidence, and a statement of accuracy. We review, share with the complainant where appropriate, and restore if resolved in your favour.
6. Repeat infringers
We keep a record of notices upheld against each account. Repeat infringers are suspended and, for continued or counterfeit-related conduct, permanently removed. Serious matters may be reported to relevant authorities.
7. Counterfeit and unsafe parts
Counterfeit parts are a safety problem, not just an IP one. Listing counterfeit, falsely branded, stolen or recalled parts is a fundamental breach of our Terms and results in immediate removal of the listing and, in most cases, the account. Buyers who believe they received a counterfeit part should report it with listing details and evidence.
