Terms & Conditions

These Terms and Conditions ("Terms") govern use of the MyFita website and mobile applications (the "Platform"), operated by Partsmart Hub Limited ("MyFita", "we", "us"). By creating an account or using the Platform, you agree to these Terms. Please also read our Privacy Policy.

1. Who this applies to

These Terms apply to everyone who uses the Platform: buyers (car owners, drivers and mechanics), vendors, suppliers and distributors who list parts, and visitors browsing without an account.

2. What MyFita is — and is not

MyFita is a marketplace that connects buyers and vendors of vehicle spare parts. We are not a party to any sale between a buyer and a vendor. We do not own, inspect, warehouse or ship the parts listed on the Platform unless explicitly stated. The contract for a sale is between the buyer and the vendor directly.

3. Accounts

You must provide accurate information when registering and keep it up to date. You are responsible for activity on your account and for keeping your login credentials confidential. Notify us immediately if you suspect unauthorised access. We may suspend or close an account that provides false information, is used fraudulently, or breaches these Terms.

4. Buying on MyFita

4.1 Listings

Vendors are responsible for the accuracy of their own listings — description, condition, price, availability and photographs. We do not verify every listing before it is published.

4.2 Enquiries and contact

When you contact a vendor about a listing, your name and contact details are shared with that vendor so they can respond. Use the Platform to make contact rather than arranging privately, so there is a record if something goes wrong.

4.5 Fitment

Confirming a part fits your vehicle is your responsibility. Check listing details against your vehicle's make, model, year and engine, and confirm with the vendor using your chassis or VIN number if unsure.

5. Selling on MyFita

5.1 Vendor verification

Vendors must complete our verification process before a storefront goes live. We may request business details, contact information and location confirmation.

5.2 Accurate listings

Vendors must list only genuine stock they can supply, with accurate descriptions, condition labels and pricing. Listing counterfeit, falsely branded, stolen or recalled parts is a fundamental breach of these Terms.

5.3 Responding to buyers

Vendors should respond to genuine enquiries promptly. Accounts that repeatedly fail to respond may be suspended.

5.4 Pricing

Vendors are responsible for keeping listed prices and stock levels current.

6. Prohibited conduct

You must not: list counterfeit, stolen or unsafe parts; misrepresent your identity or business; harass or defraud another user; circumvent the Platform to avoid fees where fees apply; scrape or copy the Platform's content or another vendor's listings; or use the Platform for any unlawful purpose.

7. Intellectual property

Content you publish (listing text, photographs) remains yours, but you grant MyFita a licence to display it on the Platform. See our Copyright Infringement page to report an IP issue.

8. Disputes between users

Return, refund and warranty terms are set by the vendor.

9. Account suspension and termination

We may suspend or terminate an account that breaches these Terms, provides false information, or engages in fraudulent or unsafe conduct, with or without notice depending on severity.

10. Disclaimers

The Platform is provided "as is". We do not guarantee that listings are accurate, that a vendor will complete a sale, or that the Platform will be uninterrupted or error-free.

11. Indemnity

You agree to indemnify MyFita against claims arising from your breach of these Terms or misuse of the Platform.

13. Changes to these Terms

We may update these Terms from time to time. Continuing to use the Platform after a change takes effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the Republic of Ghana.
